These terms and conditions apply on all orders on www.byacre.com in Europe, Asia, Australia, and Africa.
For orders to other regions, their respective terms and conditions can be reached through the footer language selector.

We only sell goods to customers who are at least 18 years old.

For business relationships between byACRE and the user (hereinafter referred to as ”customer”), the following terms and conditions apply exclusively in the current version at the time of order.

Conclusion of the Contract
The offers on this website represent a non-binding invitation for the customers to place an order with byACRE. By clicking the “Buy” button in the checkout flow, customers agree to buy the goods in the cart, and this order is legally binding. After clicking the "Buy" button in the checkout flow, changes to the order (e.g. changes to the shipping address or cancellation) can be attempted, but are not guaranteed. The customer receives an order confirmation and acceptance via email immediately after the order is transmitted. But byACRE reserves the right to limit the method of payment chosen by the customer depending on order value, shipment region, or other objective criteria.

Personal information & communication
When you place an order in our webshop you will be asked to inform us about your name, phone number, e-mail address, and home address. Besides this information, we also collect information about your purchase and your payment info.

We only use this information to process your order. Your e-mail address is used to send you an order confirmation. Your name, address, and phone number are placed on a label that we put on the package with your order in it. It might occur that we, or our shipping agency use this information to contact you if there are any questions or issues with the processing or shipment of your order.

At the byACRE online shop, you can pay with:

We use the online payment platform Stripe, which guarantees a secure and encrypted payment.

The purchase amount is not withdrawn from your account until the order has been shipped.

Prices
All prices on the webshop are end prices.

Customers outside the EU are responsible for any customs clearance and local taxation in their country.

Delivery

Delivery time:
Estimated delivery times are determined at checkout, and they are based on the destination of the products. The actual delivery of the products is performed by our shipping partners, and events outside our- or our partners’ control may delay the products’ arrival. byACRE can therefore not be held liable for late deliveries.
If the delivery estimate has been passed, please wait 48 hours to allow for unforeseen delays to resolve. If the products have still not arrived after 48 hours, please contact our customer service, and we will do our best to assist you.

Damages in Transit
In case packaging and/or products that are delivered to you are obviously damaged, please immediately file a complaint at the forwarder directly and inform us immediately. Failure to file a complaint or to contact us does not have any influence on your legal warranty claim, but it will help us to assert our own claims towards the forwarder.

Missing products
If one or more products are missing from your order upon delivery, then please contact our customer service.
Missing product claims must be made within 7 calendar days of parcel receipt.

Returns policy
We want you to be satisfied every time you shop with us. But should you for any reason be unhappy with the goods you have purchased, you may return them to byACRE within 30 days of receiving the product. Demo rollators and used spare parts are exempt and cannot be returned. In some areas, we are fortunate to be able to support the return cost, since we can obtain good terms with the shipping agencies. Unfortunately, we cannot offer this to all regions. The text below shows what terms apply to your region and who pays for the return

The condition of the product
It is your responsibility to take good care of the goods before returning them, and they must be returned in a condition where they can be resold and without any depreciation of value. This means that the rollator must show no signs of scratches or other marks from usage, the seat remains unstained, the wheels wiped clean from dirt, and show no signs of wear.

In case of depreciation of value, the amount of the depreciation will be deducted from the refunded amount.

We will not accept the return of any non-standard products, i.e. products modified to the customer’s request.

Packaging
The product has to be returned in the original packaging.

Refund of the purchase amount
If you regret your purchase you will receive a full refund within 14 days of the products returned to us. The purchase amount (excl. possible shipping costs) will be refunded with the same payment method as the one you used during your purchase unless you inform us explicitly otherwise.

Return procedure
If you are eligible for a free return (see table above) you can send us an email at customerservice@byacre.com with your name and order number and we will then help you arrange the return shipping.

Right of complaint
The Danish Sale of Goods Act rules about deficiency apply to products bought from byACRE.

When you place an order with us you have 2 years right of complaint on the products you have purchased. This means that you can either have the product repaired, exchanged, or receive a refund or a discount in price, depending on the particular situation. It is a requirement that the complaint is justified and that the deficiency is not caused by incorrect use of the product, damaging behavior, or normal wear and tear.

You have to file your complaint within a reasonable time after you have discovered the deficiency or defect in the product. If you file your complaint within two months of the purchase, the complaint will always be considered timely.

If the complaint is justified we will refund your (reasonable) shipping costs. The product always has to be returned in proper packaging. Remember to get a receipt for the return so that we can refund your shipping costs.

Warranty
We offer a lifetime warranty on the rollator frame. This is a symbol of its superior quality and strength.

The frames are warranted to be free from manufacturing defects in material and workmanship for the lifetime of the original owner. All you have to do is register your purchase on our website.

For the other rollator parts standard warranty terms apply. Any damage resulting from normal wear and tear, improper use, maintenance neglect,  damage caused by external forces, etc. is not covered by the warranty.

In order for you to place an order on our webshop we require the following information:

We use this information for the sole purpose of processing and delivering the products to you.

The information is collected by byACRE ApS and is saved for 5 years until it is deleted.

Right to complain about your purchase
If you wish to complain about your purchase you can contact us at customerservice@byacre.com. If we do not find a solution you can file a complaint to European Online Dispute Resolution on their website.
